Companion Standard Poodle Contract
1) PURPOSE
A. A major purpose of this contract is to protect, preserve, and perpetuate the standards as spelled out below of the Standard Poodle Breed.
B. This contract is executed on this the ________ day of _____________, 20____ by and between the sellers of the interest, hereinafter referred to as "sellers" or "breeders", and the buyer of the interest, ______________________________ hereinafter referred to as "Buyer" or "Owner", concerning the purchase of interest in the pet quality Standard Poodle described below for the sum of ____________________________________, US Money order or Certified Check, under the following warranties and conditions.
NO OTHER WARRANTIES OR CONDITIONS ARE EITHER EXPRESSED OR IMPLIED. This contract is being freely entered into by both parties, with no mental reservation whatsoever.

2) DEFINITIONS
A. For the purpose of this contract, companion animal shall mean a dog that has been determined to have certain qualities that make it not suitable for the conformation show ring, or breeding.
B. This puppy will be sold on AKC/UKC Limited Registration. This puppy cannot be shown for AKC/UKC Conformation Championship points, nor can any progeny from this dog ever be registered with the AKC/UKC. This puppy is sold on the condition that it will be altered by or before 10 months of age, and will never be allowed to reproduce.
C. For the purpose of this contract, OFA certification shall mean a dog certified free of hip disease in the manner as prescribed by the Orthopedic Foundation for Animals, Inc. http://www.offa.org (hereinafter OFA) as free of hip or elbow dysplasia, and given a registration number by the OFA.

3) OBLIGATIONS OF SELLER
A. Seller warrants that said dog is a purebred dog and it may be or is registered with the AKC/UKC on Limited Registration, and that said dog is produced by parents that have both received OFA normal hip certification, CERF certification with normal eyes.
B. Seller will provide buyer a true copy of said dog's AKC/UKC registration slip upon recieving Veterinary copy/notice of surgical spaying or neutering procedure performed on said companion standard poodle purchased. Seller will provide copies of Dam and Sires OFA, CERF and Generation pedigree's at the date of contract.
C. Seller warrants that this dog is healthy, and has been properly cared for up to and including the date of this contract, and will provide buyer with an individual health record for said dog, warranty VOID if dog is not examined by a licensed veterinarian within 120 hours ( 5 days) of purchase. This puppy is guaranteed against any infectious disease for 14 days from the date of this contract.
D. Seller hereby agrees that this dog may be returned to the seller at any time for any reason for the duration of the lifetime of the dog. Puppy may be returned for any reason, along with duly signed registration papers, within the first 14 days and buyer may receive a full refund, less any shipping expenses. If this puppy develops any condition that would render it unsuitable as a companion animal, or if it should develop any condition that seriously affects the quality of life of the animal before the age of 24 months, a replacement will be offered for ½ the original purchase price. Return of the original puppy is not required, only proof of sterilization. Moondance Standard Poodles uses only healthy animals for breeding who have been carefully screened for hereditary defects. We can not guarantee an OFA hip or that any dog will have a normal eyes. We do not offer cash refunds. We can only guarantee and warrant that we have used dogs proven normal for breeding.
There will be no cash refunds. This provision is of the essence of this agreement, even if no other remedy is available.
Replacements, if any, required by this agreement are excluded or limited as follows:
a) The replacement dog will be of the same, or reasonably similar, bloodline, and the next, if any, available litter
b) In the case of a serious health or temperament problem, Buyer has the option to pay a replacement fee of ½ the original purchase price for another companion animal, and must submit proof that the animal has been rendered sterile.
c) Buyer agrees that the replacement animal shall be subject to all terms and condition contained in this agreement, except that Buyer shall not be entitled to further replacements for any reason.
d) It is understood that the Seller may discontinue breeding, the sire or dam may die or become sterile, or Seller may be otherwise unable to provide a replacement, with no liability to Seller. Buyer accepts this risk.
e) No refund or replacement will be made if the fault is the result of any neglect, mistreatment, abuse, or lack of proper diet, over vaccinization, socialization, and exercise.
4) OBLIGATIONS OF OWNER
A. Owner hereby agrees to maintain this dog as a household companion. Owner agrees to properly care for and confine this dog at all times, providing a premium food or raw diet, fresh water, socialization, training, exercise, and to maintain the dog in good health at all times, with appropriate veterinary care. Buyer assumes all financial and legal responsibility for this dog from the time and date of this agreement.

B. Owner hereby agrees that this dog will never be used in violation of any local state or Federal laws, nor in any manner, which would be detrimental to the health, safety or well being of said dog. This is to include but not be limited to dog fighting and crimes against public safety.

C. Owner agrees that this dog is sold as a HOUSEHOLD COMPANION, and shall live and sleep inside the owner's home. Owner hereby agrees to keep this dog confined when outdoors in an escape-proof securely fenced area at least 5 feet in height, with all gates LOCKED at all times when not under the supervision of a qualified adult. This dog shall not be chained or tied out in any way at any time. This dog shall never be allowed to run or roam free, and must never fun free in violation of any leash law at any time.

D. Owner agrees to have this animal surgically sterilized, and to provide Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles documented proof of such sterilization from your veterinarian.
Your dog should be neutered between the ages of 4 and 10 months of age. If owner should fail to provide the proof of spay or neuter by the required time, there will be one warning, with 30 days to comply. If after the warning and the 30-day grace period this animal has not been altered, Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles reserves the right to repossess this animal and have it altered. Owner will be liable for any expenses incurred for alteration and surgery. Option of returning the dog to owner in the event of this noncompliance will be at the sole discretion of Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles.

E.Owner agrees that Registration of said nuetered/spayed dog, with the AKC/UKC will carry the kennel name prefix: Moondance.
Dog’s AKC/UKC registered name will be discussed with Buyer and Seller and shall be approved by Seller prior to registry.
Also, all advertising of dog paid for by Buyer will include breeder's name and kennel name.
F).Owner agrees that in the event owner no longer wishes to keep, or is unable to keep this dog for any reason whatsoever. Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles will be notified at once. Both sellers will be offered the FIRST RIGHT OF REFUSAL to purchase the dog at the original purchase price. Buyer has read and understands the FIRST RIGHT OF REFUSAL or OPTION CONTRACT attached hereto. Under no circumstances shall this dog be sold or transferred to any commercial breeder. Dog shall not be sold, transferred, given away, disposed of, or change ownership or homes without the express written permission and approval of Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles. Should this dog be so transferred in any manner in violation of this agreement, Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles shall be entitled to damages up to 10 times the purchase price or $10,000.00US, which ever is greater. Owner agrees to keep Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles advised of current address, telephone number, and any other contact information for the lifetime of the dog. Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles shall be notified immediately of any serious illness, injury, or death of said dog.

G. Owner hereby agrees that any abuse or neglect of the dog whether it by physical, mental or otherwise, whether intentional or involuntary, will void all warranties and claims to this dog, and that all rights and legal claims and full ownership will immediately revert to the seller with no recourse to owner whatsoever. 5) CONDITIONS OF CONTRACT
A. New owners are strongly encouraged to join the American Poodle Club for education and support.
B. No other conditions noted.
6) LEGAL RESPONSIBILITIES
A. In the event of transfer of ownership or transfer of interest of said dog from owner, whether intentionally or unintentionally, with or without consideration, seller's obligations shall end and owner shall provide that all interests of seller, financial or otherwise, shall pass in full and be legally binding on the subsequent owners of this dog.
B. In the event any legal action is necessary by either owner or breeder to enforce the terms of this contract, the prevailing party shall be entitled to recover, in addition to any other sums as may be due, the cost of said legal action, including but not limited to reasonable attorney's fees.
C. Owner agrees to indemnify and hold seller harmless for any legal actions resulting or arising from the actions of said dog.

7) EXECUTION; COUNTERPARTS:
READ THE ADDITIONAL PROVISIONS attached herewith. When you sign this contract, you acknowledge you have read and agree to the provisions of this contract, including the Additional Provisions and the Option Contract. This contract is executed in two (2) counterparts, with an executed counterpart retained by each party hereto.
8) LEGAL RESIDENCE
A. The laws of the State of Virginia, Suffolk County, will govern all legal questions or disputes regarding this agreement.

This is to be a legally binding contract for the ownership of a Moondance Standard Poodle.
Co-Ownership Show/Breeding Prospect Standard Poodle Contract
1) PURPOSE
A. A major purpose of this contract is to protect, preserve, and perpetuate the standards as spelled out below of the Standard Poodle Breed.
B. This contract is executed on this the ________ day of _____________, 20____ by and between the seller of the interest, Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles, hereinafter referred to as "seller" or "breeder", and the buyer of the interest, ______________________________ hereinafter referred to as "Buyer" or "Owner". Concerning the purchase of interest in the show prospect Standard Poodle described below for the sum of ____________________________________, US Money order or Certified Check, under the following warranties and conditions.
2)Purchase price does not include cost of shipping. Buyer is designated as being responsible for all transportation costs and shipping costs incurred during purchase of dog, or return or replacement of dog. This includes health certificate, airline crate, airfare, and $50.00 delivery charge for each trip, to or from the airport to the Seller’s home. Shipping cost includes Health Certificate, Airline Kennel, and Cost of Ticket. All Shipping cost must be paid in advance. Health Certificate is for Airline use only. Any shipping expenses due to return and/or replacement of dog are also Buyer’s obligation.
3) Registration of said dog with the AKC/UKC will carry the kennel name prefix: Moondance.
Dog’s AKC/UKC registered name will be discussed with Buyer and Seller and shall be approved by Seller prior to registry. If dog is to be shown, Buyer will provide Seller with clear photographs suitable for advertising between the age of six months and 18 months.
Also, all advertising of dog paid for by Buyer will include breeder's name and kennel name.
NO OTHER WARRANTIES OR CONDITIONS ARE EITHER EXPRESSED OR IMPLIED. This contract is being freely entered into by both parties, with no mental reservation whatsoever.

2) DEFINITIONS
A. For the purpose of this contract, show prospect shall mean a dog that is free from major faults (Section 2, B) and estimated to be capable of achieving an AKC and or UKC Championship title with proper handling and promotion.
B. For the purpose of this contract, major faults shall mean those faults recognized by the American Poodle Club breed standard, American Kennel Club and United Kennel Club breed standard in force at the time of the signing of this contract, which would disqualify this dog from competition in AKC or UKC conformation events.
C. For the purpose of this contract, OFA certification shall mean a dog certified free of hip disease in the manner as prescribed by the Orthopedic Foundation for Animals, Inc. http://www.offa.org (hereinafter OFA) as free of hip or elbow dysplasia, and given a registration number by the OFA.
3) OBLIGATIONS OF SELLER
A. Seller warrants that said dog is a purebred dog and may be registered with the AKC and UKC, and that said dog is produced by parents that have both received OFA normal hip certification and screening, CERF certification with normal eyes.
B. Seller will provide buyer at the time and date of this contract a true copy of said dog's AKC/UKC registration slip or litter registration slip and a true copy of said dog's pedigree of at least 3 generations.
C. Seller warrants that this dog is healthy, and has been properly cared for up to and including the date of this contract, and will provide buyer with an individual health record for said dog, warranty VOID if dog is not examined by a licensed veterinarian within 120 hours (5 days) of purchase. This puppy is guaranteed against any infectious disease for 14 days from the date of this contract.
D. Seller hereby agrees that this dog may be returned to the seller at any time for any reason for the duration of the lifetime of the dog. Puppy may be returned for any reason, along with duly signed registration papers, within the first 14 days and buyer may receive a full refund, less any shipping expenses. If this puppy develops a disqualifying fault, does not receive an OFA hip number. If it has a hereditary eye defect, or any condition that would render it unsuitable as a companion animal, or if it should develop any condition that seriously affects the quality of life of the animal before the age of 24 months, a replacement will be offered for ½ the original purchase price. Return of the original puppy is not required, only proof of sterilization. Moondance Standard Poodles uses only healthy animals for breeding who have been carefully screened for hereditary defects. D. Owner Understands Poodles are a HIGH MAINTENANCE breed, requiring professional grooming even as a pet every 6-8 weeks for the life of the dog with an average cost of 70.00 dollars each grooming. Buyer is willing and able to have their dog groomed or has the knowledge and equipment to groom the dog themselves.
D. Owner agrees to have this dog OFA certified for hips and a CERF test done at the age of 24 to 28 months of age, and have copies of all results sent to Breeder so that this dog will have documentation on file with the OFA. This dog may not be bred or used for any breeding purposes unless and until ALL of the following conditions are met, nor will this dog be bred to any other dog not meeting the same requirements:
a) Dog (dog shall mean any dog, male or female) must be AKC/UKC registered, or registered with an international registry recognized by the AKC.
B) Breeding will only be done with another AKC or UKC Champion.
c) No cross breeding will be done with said dog. Only breeding with another Standard Poodle is allowed or contract is null and void.
d) Dog must have OFA hips.
e) Dog must have a current CERF & negative Brucellosis. CERF testing yearly.
f) Buyer agrees to only breed bitches ethically at once a year, skipping every other estrous cycle.
e) Bitches will not be bred past their 6th year of life.
g) All dogs will be surgically sterilized once their show and breeding careers have ended.
h) A Show/Breeding prospect dog will have no disqualifying faults for exhibition in AKC/UKC conformation events or to make breeding inadvisable. A show/breeding prospect dog that has not yet been titled nor produced a litter for puppies/breedings back to the Seller MUST NOT be spayed/neuter under Buyer’s actions without written permission from Seller or unless an emergency arises which would endanger this dog’s health and well being. If show prospect dog is altered without Seller’s permission, unless emergency surgery to save this dog’s life, an additional $2,500.00 will be paid to Seller for damages from loss of show dog and breeding prospect produced to carry on Breeder’s lineage. Upon completion of AKC/UKC Championship title, Seller will sign off as owner of said dog with and AKC/UKC papers will be fully transferred to Buyer. Buyer understands that 1 breeding and 1 show prospect puppy (for board during showing towards AKC/UKC championship) will still be owed to Seller and knows that she is legally obligated under contract to fulfill her agreement.
E. Owner agrees to make a reasonable effort to promote this dog in the eye of the general public and among dog fanciers. Owner agrees to make every effort to finish-said dog's AKC and or UKC CH title. Breeder will show said dog free of charge excluding entry fees and reasonable boarding fees when traveling and/or keeping dog overnight.
F. Owner agrees that in the event owner no longer wishes to keep, or is unable to keep this dog for any reason whatsoever that Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles will be notified at once, and offered the FIRST RIGHT OF REFUSAL to purchase the dog at the original purchase price. Buyer has read and understands the FIRST RIGHT OF REFUSAL or OPTION CONTRACT attached hereto. Under no circumstances shall this dog be sold or transferred to any commercial breeder. Dog shall not be sold, transferred, given away, disposed of, or change ownership or homes without the express written permission and approval of Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles. Should this dog be so transferred in any manner in violation of this agreement, Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles shall be entitled to damages up to 10 times the purchase price or $10,000.00US, whichever is greater. Owner agrees to keep Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles advised of current address, telephone number, and any other contact information for the lifetime of the dog. Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles shall be notified immediately of any serious illness, injury, or death of said dog.
Right of First Refusal: In the event that dog is a show dog that has attained a greater value due to titles and health testing and Buyer should ever decide to sell this dog, Seller shall have the right of first refusal. Buyer shall offer said dog to Seller for a price equal to what he will be offered to the general public. Only written offers to Seller from Buyer will be legally binding. Said offers shall be made by certified mail, return receipt requested. Buyer shall not sell this dog for 15 days after receipt of notice by Seller. Seller shall have 15 days to respond to Buyers sales offer. If Seller does not respond or declines to purchase this dog, buyer shall be free at the end of the 15-day waiting period to sell said animal to another person at no less than the price offered to Seller.
If dog is to be sold to a 3rd Party, Buyer must supply Seller with valid contact information of the new owner. Full name, address, phone, and email shall be sent to Seller before the final transaction takes place. Sellers contact information shall be supplied to new owners as well. It will be impossible for me to keep tabs on my pups if they are sold and I do not know with whom they now live.
G. Return of Dog - If the buyer cannot care for this dog at any time in the dog’s life it is to be returned to the breeder without refund of purchase price. The breeder is then free to place or keep the dog. Under no circumstances shall this dog be placed in an animal shelter, Rescue, Newspaper advertisement, privately sold or public place of adoption
H. Owner hereby agrees that any abuse or neglect of the dog whether it by physical, mental or otherwise, whether intentional or involuntary, will void all warranties and claims to this dog. That all rights and legal claims and full ownership will immediately revert to the seller with no recourse to owner whatsoever. Dog will immediately and peacefully be surrendered with properly signed over registration papers.
I. Owner agrees that any breeding made in violation of the terms and conditions of this contract wherein a litter is whelped will result in a monetary penalty of $10,000.00.
J. Buyer hereby agrees to honor and comply with all conditions of this agreement, and agrees that failure to do so will void all claims to this dog, and that all rights and legal claims and full ownership will immediately revert to the seller with no recourse to owner whatsoever. 5) CONDITIONS OF CONTRACT
A. Breeder shall be entitled to the following compensation if and when any of these dogs meet all requirements for breeding:
a) MALE DOGS: In the event this dog is left intact, Breeder will retain the right to send bitches owned or co owned to this dog for breeding at no charge, and also will retain the right to collect and store semen from this dog for future use.
b) FEMALE DOGS: In the event this bitch is bred, Breeder shall have the right to select the male dog for this bitches first breeding, and to select the first choice puppy from the bitch's very first litter. If the first litter is less than 4 puppies, breeder will select from the following litter.
B. Upon the completion of the CH title and all health testing, and in the case of a bitch, after the puppy back provision has been satisfied, or in the event that any dog is rendered sterile after CH title and all health testing, breeder will sign off and end the co-ownership agreement.
C. All puppies produced by any animal governed by this agreement will be sold under contract only and according to the Code of Ethics provisions of the American Poodle Club.
This dog or any puppies produced from this dog cannot be sold to Animal Brokers, Pet shops, Puppy Farm or Dog Dealers (Buyers of Puppy Litter Lots). No Breeding to any other breeds of dogs, only the Standard Poodle Breed. New owners are strongly encouraged to join the Poodle Club of America for education and support.
6) LEGAL RESPONSIBILITIES
A. In the event of transfer of ownership or transfer of interest of said dog from owner, whether intentionally or unintentionally, with or without consideration, seller's obligations shall end and owner shall provide that all interests of seller, financial or otherwise, shall pass in full and be legally binding on the subsequent owners of this dog.
B. Buyer agrees that Seller is not responsible for the actions or safety of this dog, once it leaves Seller's possession . Buyer hereby indemnifies and releases the Seller from responsibility, of any and all costs involving liabilities and/or damages caused by fault of said dog once dog has left the Seller and is in the care and possession of the Buyer. The dog is solely the Buyer’s responsibility and the Buyer shall be the only source of liability. Buyer shall make themselves aware of the dog laws in their area. Buyer agrees to be a responsible owner and use logical judgement in everyday ownership of dog to safeguard themselves from personal suit and liability that can happen due to dog ownership.
C. In the event any legal action is necessary by either owner or breeder to enforce the terms of this contract, the prevailing party shall be entitled to recover, in addition to any other sums as may be due, the cost of said legal action, including but not limited to reasonable attorney's fees.
7) EXECUTION; COUNTERPARTS:
READ THE ADDITIONAL PROVISIONS attached herewith. When you sign this contract, you acknowledge you have read and agree to the provisions of this contract, including the Additional Provisions and the Option Contract. This contract is executed in two (2) counterparts, with an executed counterpart retained by each party hereto.
8) LEGAL RESIDENCE
The laws of the State of Virginia, Suffolk County, will govern A. All legal questions or disputes regarding this agreement.

Option Contract

Putt Sr. of Moondance Standard Poodles, the first and only option to purchase the Standard Poodle commonly known and identified as ________________________________________________________________________________

Should the Standard Poodle ever be offered for sale, or should the Owner wish to give or grant possession and ownership of the Standard Poodle to any other person, whether actual or legal. This option contract shall run for the lifetime of the dog identified above, and may be made null and void only by the express written refusal to exercise the option by Karri L. Whitefish Bodoh and David E. Putt Sr. of Moondance Standard Poodles, should the Standard Poodle ever be put up for sale, or offered to another person, whether actual or legal.
